  4. Using automated systems, bots, scrapers, crawlers, or other data extraction tools to access, collect, or monitor the Website or its content without express written permission from Swiss Chalet.

5.2 Pricing

All prices displayed on our Website are in Canadian Dollars (CAD) unless otherwise stated. Prices are subject to applicable federal Goods and Services Tax (GST), Harmonized Sales Tax (HST), and/or Provincial Sales Tax (PST) as required under the Excise Tax Act (R.S.C., 1985, c. Prices for menu items are subject to change without notice. Promotional pricing is valid only for the period specified and is subject to applicable terms and restrictions.

5.4 Refunds and Cancellations

Our refund and cancellation policy is subject to the nature of the order and the circumstances surrounding the request. In general:

  • Orders cancelled prior to preparation may be eligible for a full refund.
  • Orders that have been prepared or are in transit are generally non-refundable, except in cases of verifiable food quality issues or order errors attributable to Swiss Chalet.

Swiss Chalet gift cards and promotional codes are subject to separate terms and conditions. Gift cards have no expiry date unless otherwise specified and are non-refundable and non-redeemable for cash except as required by applicable provincial law. Promotional codes are valid for a limited time, cannot be combined with other offers unless expressly stated, and are non-transferable.

6. Food Safety, Allergen Information, and Dietary Disclosures

Swiss Chalet is committed to providing safe and high-quality food products. Nothing in these Terms shall limit or exclude liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under applicable Canadian law, including the Competition Act (R.S.C., 1985, c. C-34) and applicable provincial consumer protection legislation.

8. Disclaimers — Services Provided on an "As-Is" Basis

THE WEBSITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SWISS CHALET EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

11. Governing Law and Jurisdiction

The parties irrevocably agree that the courts of competent jurisdiction in Canada shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation. By using our Services, you consent to the personal jurisdiction of such courts and waive any objection to the laying of venue of any such proceeding in such courts.

12. Dispute Resolution

12.1 Informal Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms, the Website, or the Services (collectively, "Dispute"), the parties agree to first attempt to resolve the matter informally. 12.2 Mediation and Arbitration

If the parties are unable to resolve a Dispute through informal negotiation within sixty (60) days of written notice, the parties may mutually agree to submit the Dispute to non-binding mediation conducted by a neutral mediator agreed upon by both parties, in accordance with Canadian mediation standards and practices.

For Disputes that cannot be resolved through negotiation or mediation, the parties agree that binding arbitration may be pursued in accordance with the Arbitration Act of the applicable province, or the Commercial Arbitration Act (R.S.C. 1985, c. 17 (2nd Supp.)) for matters of federal jurisdiction. Any arbitration shall be conducted in Canada in the English language.

12.3 Consumer Rights

Nothing in this Section shall limit your rights as a consumer under applicable provincial consumer protection legislation. Canadian consumers retain all rights afforded to them under applicable law, including rights of redress through provincial consumer protection offices and ombudsman services.

13. Term and Termination

Swiss Chalet reserves the right, in its sole discretion, to terminate or suspend your access to the Website and Services, with or without notice and with or without cause, including but not limited to the following circumstances:
